Welsh-born singer Tom Jones is known for his smooth vocals and gyrating hips.

But his act and his fame didn’t matter in Broward Circuit Court on Tuesday. The singer lost another court battle to a woman who claims he is the father of her 7-year-old child.

Circuit Judge Charles Greene on Tuesday ruled that a New York agreement Jones and the woman signed doesn’t hold up in Florida.

The woman, Katherine Berkery, of Plantation, signed an agreement in 1989 stating that Jones, whose real name is Thomas John Woodward, would make monthly support payments of $2,791 until the boy reaches 21.

Neither Jones nor Berkery, who could not be reached for comment, appeared in court. Berkery has said that Jones, 56, fathered the child when the two spent two nights together at the Ritz-Carlton Hotel in New York in October 1987. She said they met at Regines, a Park Avenue nightclub.

Despite the agreement, Berkery, 33, filed a petition in January asking a judge to increase the payments. Her attorneys say Jones’ income has “skyrocketed” and he should pay more.

“The agreement calls for a fixed payment for 21 years and there isn’t even a cost of living increase,” said Howard I. Weiss, who is representing Berkery. “The child was born in Florida, and he and his mother live in Florida. This state’s laws should supersede those in New York.”

Weiss said the amount his client will ask for depends on Jones’ income, and had not been determined. The court fight is expected to continue in a later hearing to determine whether Jones will be forced to increase the payments.

No date has yet been set.

Jones’ attorneys argued that the agreement should stand because no Florida court should be able to overrule an agreement made in another state’s courts.

“What we have here is a court order made binding and enforceable in a sister court,” said Burton Young, who is representing Jones. “We might say ‘Gosh, this is a dumb law,’ but it’s the law and we must abide by it.”

Under the 1989 agreement, Jones also pays tuition for private schools as well as undergraduate college tuition.

Jones’ representatives in 1989 denied that he fathered the child, but DNA tests indicated a 99 percent chance that Jones is the boy’s father.

The child, Jonathan Jones Berkery, was born on June 27, 1988.
